SELECT PRACTICE AREAS

·        Asset Finance – Greys’ Legal Chambers has advised major national and international banks and other financial institutions, private wealth funds, investors and businesspersons in relation to the purchase or construction of assets.

·        Banking & Finance – Saint Kitts and Nevis boasts several local banks and branches of international and offshore banks, Greys’ Legal Chambers has and can advise borrowers, sponsors and lenders in respect of the review and drafting of transactional documentation and where needed litigation support – matters arising out of commercial banking activity.

·        Civil Liberties & Human Rights – GLC advises regularly on matters on the liberty of persons under the Constitution.

·        Commercial and Corporate Litigation – as an offshore jurisdiction with a range of differentiated products (e.g. Nevis Trusts, Nevis LLC’s, Saint Kitts Companies, Nevis Business Corporations etc.), disputes in respect of commercial or other arrangements often arise, GLC has significant expertise in the resolution of such disputes e.g. corporate control issues , joint venture disputes and shareholder disputes.

GLC also covers domestic or ‘local’ commercial litigation, we have found that timeliness is key in the resolution of disputes and have promoted the use of alternative dispute resolution methods such as mediation (court connected mediation in the Federation etc.) and arbitration (including the enforcement of foreign obtained arbitral awards).

·        General Corporate Law – GLC covers both public and private company transactions. We have experience in the incorporation of companies, facilitating company and share acquisitions, dispositions, capitalization, entity selection and formation (inclusive of Nevis corporate entities), drafting of operating and partnership agreements, advising on securities and governance matters.

We have also advised on the restructuring aspects of Saint Kitts and Nevis companies in respect of cross border structures.

GLC covers work at all levels from initial police dealings, high court advice and jury trials, all the way to the Court of Appeal of the Eastern Caribbean and the Privy Council.

·        Financial Crime – GLC also handles a broad range of financial crime matters under the laws of the Federation of Saint Kitts and Nevis, including but not limited to, fraud, bribery, money laundering and sanctions breaches (especially for offshore companies).

·        Family / Matrimonial – GLC deals with issues surrounding the inception and breakdown of personal relationships. This includes agreements relations to financial and property assets and disputes relating to same.

The resolution of divorces or separations involving financial and property disputes, and the handling of matters relating to children in the context of divorce or separation.

GLC also handles all aspects of domestic and international adoption.

·        Insolvency Law: GLC understands the various insolvency frameworks within the Federation of Saint Kitts and Nevis and how they govern the position of businesses and individuals who are in financial difficulties and unable to repay their debts as they become due. Such a situation may lead to insolvency proceedings, in which legal action is taken against the insolvent entity and assets may be liquidated to pay off outstanding debts to banks and creditors. Before a company or individual gets involved in insolvency proceedings, they will probably be involved in a restructuring or an out-of-court arrangement with creditors to work out alternative repayment schedules. The work of GLC in the field can therefore be non-contentious (restructuring) or contentious (insolvency litigation), and our role will vary depending on whether they act for debtors or their creditors.
